Welcome to PositionTiger. These terms and conditions define the rules and regulations for using the PositionTiger website and services.

By accessing this website and using our services, you agree to these terms. If you disagree with any part of the terms, please do not use PositionTiger.

You must be at least 18 years old to use our services. By using PositionTiger, you represent and warrant that you are at least 18 and have the legal capacity to enter into these terms.

All payments on PositionTiger are securely processed by Stripe, our payment provider.

Stripe processes credit-card and other payment methods on our behalf. PositionTiger remains the seller of the service; Stripe only handles the secure transmission of your payment details and never shares your full card information with us.

By using PositionTiger, you agree to use the service only for lawful purposes and in compliance with applicable laws.

Acceptable use

• Respect the rights and privacy of others
• Provide accurate information in your account
• Maintain the security and confidentiality of your account
• Stay within the technical limits of the service (for example the number of API requests)

Prohibited uses

• Engaging in illegal activities
• Attempting to reverse engineer or hack our services
• Reselling or redistributing our data without permission
• Using automated systems to abuse our infrastructure
• Providing false or misleading information

Account responsibilities

You are solely responsible for keeping your account credentials confidential.

You must ensure all information you provide is accurate and up to date.

You must notify us immediately about any unauthorized use of your account.

Service overview: PositionTiger provides SEO rank tracking so you can monitor how your keywords perform in search engines.

Availability: We aim for 99.9% uptime, subject to required maintenance and updates.

Features: Our platform includes rank tracking in Google's Top 60, competitor analysis, shareable reports and an API.

Non-transferable license: Your access is non-transferable and cannot be shared, sold, or sublicensed without written approval.

Billing system: There is no subscription. You buy pages through prepaid top-ups, which are added to your balance: a manual top-up is €10, €25, €50, €100, €250 or €500 excluding VAT. Each check of a keyword reads the Top 60, which is 6 pages, taken from your balance; the frequency you choose sets the number of checks. If you turn on auto-reload, your card is charged the amount you chose (€10 to €100,000 excluding VAT per reload) when your balance falls below the threshold you chose, and also before an action or a check your balance cannot cover (adding, refreshing or importing keywords, a scheduled check), even when the balance is still above the threshold; at most one reload per action and 3 per 24 hours. You can turn it off at any time in the settings.

Payment processor: All payments are securely processed by Stripe in a PCI DSS compliant environment.

Taxes and VAT: Amounts exclude VAT: 20% VAT (French VAT) is added to every top-up and every auto-reload, whoever the buyer. Stripe issues an invoice for each one and emails it; each payment's receipt is also linked from the transaction history in the settings.

Price changes: We may adjust pricing, and customers are notified at least 30 days before any change takes effect. Pages already bought keep their value: a new price only applies to later top-ups.

Right of withdrawal (14 days)

You have 14 days from each top-up to withdraw: the pages of that top-up you have not spent yet are then refunded. Pages already spent correspond to checks made at your request and are not refunded. After those 14 days, top-ups are no longer refundable.

Eligibility requirements

• Requests must be made within 14 days of the top-up
• Only pages bought and not yet spent are refunded; free pages (the signup bonus) are not
• The amount refunded is the price paid for those pages, VAT included
• Refunded pages are removed from your balance
• The account must not have violated our terms of use

How to request a refund

Email [email protected] with your account details to request a refund. Refunds are typically processed within 5 to 10 business days.

We reserve the right to refuse service to anyone for any reason. That includes, but is not limited to:

• Violations of our terms of use
• Abusive or fraudulent behavior
• Non-payment or payment disputes
• Excessive resource usage that impacts other users
• Legal or compliance requirements

If service is terminated because of violations, no refunds will be issued.

Limitation of liability

PositionTiger provides its services "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free service, nor that the service will meet your specific requirements.

No warranties

We expressly disclaim all warranties of any kind, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of data

Limitation of damages

PositionTiger will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability is limited to the amount you paid during the previous 12 months.
